Support for People with IDD Facing Criminal Charges
When a person with an intellectual disability is charged with a crime, they may face extra challenges in the criminal justice system. Special evaluations and training are sometimes needed to make sure the person understands their rights and can participate in their defense.
Competency Evaluation and Training:

- If there are concerns about the defendant’s ability to stand trial, the court may order a competency evaluation.
- Community mental health providers or regional mental health institutes usually perform the first evaluation.
- For felony charges, the Department of Mental Health and Substance Abuse Services (TDMHSAS) may ask the Department of Disability and Aging (DDA) to provide competency training for people who are not yet competent but could be trained.
- Competency training uses programs designed for people with intellectual disabilities to teach them about their rights and the court process.
- After training, a forensic evaluator from the DDA reports the results to the court, along with recommendations for any accommodations or supports the person may need.
Judicial Commitment to the Harold Jordan Center (HJC):

- If a person with an intellectual disability is found to meet the criteria for judicial commitment, they may be ordered to receive care at the Harold Jordan Center (HJC).
- The Harold Jordan Center is a specialized forensic facility that serves up to 4 individuals with intellectual disabilities who have been charged with a crime.
Criteria for Commitment to HJC:
To be admitted to HJC, the court must find that:

- The person has an intellectual disability.
- The person is at risk of seriously harming themselves or others due to their disability.
- The person needs care, training, or treatment because of their disability.
- There are no less restrictive options that can meet the person’s needs.
- The district attorney general files a complaint requesting involuntary care and treatment.
What Happens at HJC:

- Defendants at HJC receive treatment and training to help them become competent to stand trial.
- If they become competent and no longer pose a risk of harm, they return to jail and continue with their legal process.
- If they do not become competent, the court may dismiss the charges. HJC then works to create a long-term placement plan that reduces risks to the community.
